Directors Amoroso, Bender, Kimball, Siedman and Smith present;  director Bender appeared by telephone.  Director Siedman presiding.

3.    Closed Session:  CONFERENCE WITH LEGAL COUNSEL – SIGNIFICANT EXPOSURE TO LITIGATION (Gov. Code Sections 54956.9(b)(1), 54956.9(b)(3)(A))

The Board convened in closed session to confer with legal counsel.

4.  Report from Closed Session

Director Siedman reported that the Board took the following action in closed session:  the Board directed the General Manager to review the district policies, if any, with regard to “will serve” letters and respond in writing to a communication received from a Mr. Gregg Berge by providing him copies of such policies, if any, as well as a copy of a letter dated June 27, 2008, in which the district responded to a similar communication from Mr. Berge.  The Board further directed the General Manager to advise Mr. Berge that all communications between the district staff and Mr. Berge must be in writing.
