1.  Call to Order

    5:00 p.m.

2.  Roll

Directors Amoroso, Bender, Kimball, Siedman and Smith present; director Siedman presiding.

3.    Closed Session:  CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED  LITIGATION Gov. Code Section 54956.9(b)(1)

    The Board adjourned in closed session to confer with legal counsel.

4.  Report from Closed Session

The Board reviewed and discussed a “cease and desist” letter and accompanying report alleging violations of the BCPUD’s waste discharge requirement permit for the district’s wastewater treatment facility.  The allegations are of runoff from the BCPUD’s property onto the neighboring property owned by Ashley and Tobin Whamond.  The Board directed the General Manager to ensure the preparation of a letter responding to the letter from the Whamond’s attorney and a letter to the BCPUD’s primary wastewater regulator, the Regional Water Quality Control Board.  The Board also directed the General Manager to research appropriate consultants to evaluate the report, and present the Board with a recommendation for hiring a consultant.
