MINUTES




1.  Call to Order.

    10:03 a.m.

2.  Roll

    Directors Amoroso, Siedman and Smith present; directors Kimball and McClellan absent.  Director Siedman presiding.

3.  Resolution 571:  Designating an Authorized Representative and Authorizing the Submission of a Loan Application by the Bolinas Community Public Utility District to the California Department of Public Health’s Safe Drinking Water State Revolving Fund.

V. Amoroso/D. Smith    all in favor    to approve Resolution 571, which designates the General Manager as the district’s Authorized Representative and authorizes the submission of a loan application to the CDPH’s SDWSRF.

4.  Community Expression.

    Staff reported that the County has responded to the district’s Public Records Act request; in this letter, the district requested that the County provide the district will all documents in its possession or under its control relating to Terrace Avenue and the County’s seawall below.  Director Siedman recommended that the Board include an agenda item on the November 19, 2008 regular meeting agenda to consider the County’s response.  Discussion ensued as to whether the seawall is within the County right-of-way, or on private property.  Director Siedman noted that there is no dispute that the County installed the seawall, and the County would have had to obtain easements to install the seawall if it or any portion thereof is on private property.  In any event, the County has a continuing obligation with regard to maintenance of the seawall.  Director Smith commented that at the most recent Bolinas Fire Protection District Board meeting, Phil Buchanan suggested that the engineers who designed the beach groin might be able to provide the district with an assessment of the seawall and/or potential stabilization options.
