RESOLUTION NO. 207
Eliminates "Grandfathered" Exceptions To Water Moratorium


WHEREAS, paragraph 5 of Resolution No, 173 passed and adopted by the Board of Directors on July 20, 1977, prohibits new or addi-tional service connections, meters, or other water hookups except for limited expansion of existing services (as provided in paragraph 6 thereof), and except in the following "grandfathered" cases: A. When the meter application was made on or before November 26, 1971; B. When the building to be served was under construction on or before November 26, 1971, or C. When a building permit or septic tank permit was issued or applied for on or before November 26, 1971, for the building to be served; and

WHEREAS, the District has no record of the number of "grand-fathered" cases which exist within the District, but needs such information in order to carry out its duties in an equitable manner and so that it can allow additional connections at the earliest feasible time consistent with the present water shortage emergency condition and the terms of Resolution No. 173; and

WHEREAS, those persons owning property within the District qualifying under any of said "grandfather" clauses have had ample time since November 26, 1971, in which to pay for and obtain water meters;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BOLINAS COMMUNITY PUBLIC UTILITIES DISTRICT that:

1. Effective May 1, 1979, paragraph 5 of Resolution No. 173 is amended to read as follows:

"No new or additional service connections, meters, or other water hookups shall be made, allowed, approved, installed, or accepted by the District except as set forth in paragraph 6."

2. This resolution is intended to and will eliminate the exceptions to the water moratorium for the "grandfathered" cases described above. However the application of any person applying for a water meter before May I, 1979, under a "grandfather" clause will be processed and acted upon under Resolution No. 173 as it existed prior to passage of this resolution.

3. Anyone who owns property within the District which falls within such "grandfather" clause (or which the owner believes may fall within such "grandfather" clause) is advised, if such owner wishes to obtain a water meter prior to the end of the present water moratorium, to apply to the Bolinas Community Public Utilities District, 270 Elm Road (Box 390), Bolinas, CA 94924, before May 1, 1979, for such water meter.

4. Not later than March 7, 1979, a copy of the notice attached hereto as Exhibit A shall be published in the Point Reyes tight, in the Hearsay News, and in the Great Western Pacific Coastal Post, a copy thereof shall be posted at the office of the Bolinas Community Public Utilities District and copies shall be made available to the Bolinas Property Owners Association, the Marin County Recorder, the Marin County Assessor, the Marin Board of Realtors, the Independent Journal, the Pacific Sun, and to any other interested person or groups so requesting.
