Approves Actions Taken By District Manager To Ensure That All BCPUD Fees And Charges Comply With The Restrictions And Rate Calculations Requirements Of Proposition 218

BE IT RESOLVED by the Board of Directors of the Bolinas Community Public Utility District as follows:

1. The District Manager has examined the current charges and fees for water and sewer service and has determined that:

a. None of the current charges and fees for water and sewer service is levied to pay for a general governmental service.

b. None of the current charges and fees for water and sewer service is imposed for a service not used by, or immediately available to, the property owner.

c. None of the current charges and fees for water and sewer service is used to finance programs unrelated to the service provided.

2. The District Manager has examined the current charges and fees for water and sewer service and has determined that none of the current charges and fees for water and sewer service is greater than the proportionate cost to provide the service to a given property.

IT IS HEREBY CERTIFIED that this resolution was duly introduced and adopted by the Board of Directors of the Bolinas Community Public Utility District this 19th day of July, 2000, by the following vote:

AYES: Amoroso, Bertsch, Kayfetz, McClellan, Siedman
