States Policy Re: Disposition of District-Owned Undeveloped Parcels On The
Bolinas Mesa
BE IT RESOLVED by the Board of Directors of the Bolinas
Community Public Utility District as follows:
It is the policy of Bolinas Community Public Utility
District to retain title to undeveloped parcels of property on the Bolinas
Mesa, and to preserve such parcels as open space in perpetuity. An exception
to the policy may be made, at the discretion of the Board of Directors, when
all of the following conditions are met:
1. An owner of adjacent, inhabited residential property has a failing
septic system.
2. The controlling regulatory authority has notified the owner of
imminent enforcement action that will result in the loss of housing.
3. Acquisition of the adjoining BCPUD-owned parcel is necessary to
correct deficiencies in the failing septic system.
4. The controlling regulatory authority will not approve plans and
issue a permit for repair or replacement of the failing system without acquisition
of the parcel by the affected owner.
Nothing in the foregoing conditions shall prevent the Board of Directors
from selling a BCPUD-owned parcel if it be found in the public interest to
do so.
IT IS HEREBY CERTIFIED that this resolution was duly
introduced and adopted by the Board of Directors of the Bolinas Community
Public Utility District this 15th day of January, 2003, by the following
vote:
