Resolution No. 487
Amends Resolution 354; Requires District to consider impacts of issuance
of an Expanded Water Use Permit on an applicant’s septic system; Amends
Resolution 173
Whereas Bookman-Edmonston Engineering, in its Water
Supply Study, stated: “As part of an overall water supply plan, it will
be necessary for the District to address the impacts of increased deliveries
to the Gridded Mesa area on existing sewage disposal problems”, and
Whereas Alameda Superior Court-appointed Special Master
Walter Bourez, P.E., in his report to the court of an investigation of BCPUD’s
water system, stated “There are other environmental issues that the BCPUD
will have to address before allowing additional water service hookups. The
geology has caused the Bolinas area to experience problems with the failure
of individual sewage disposal systems. I believe this is the
most critical of the issues that need to be resolved before any additional
water hookups to the BCPUD system is allowed.” now, therefore,
Be it resolved by the Board of Directors of the Bolinas Community Public
Utility District as follows:
Resolution 173, §6 is hereby amended, adding the
following language as a new last paragraph:
“As a part of its deliberations concerning any and all
applications for expanded water service, the Board of Directors shall consider
the impact of such expansion on the proper functioning of the applicant’s
septic system, and may require as a part of such deliberations that the
applicant provide evidence as may be required by the Board of Directors
that the existing system, or any and all proposed improvements to the existing
system, will not create or cause a public health nuisance or hazard.”
Passed and adopted by the Board of Directors of the Bolinas Community Public
Utility District this 16th day of April, 2003, by the following vote:
