BOLINAS COMMUNITY PUBLIC UTILITY DISTRICT

Resolution No. 538

Stating the Policy of the BCPUD Board of Directors with regard to the Use of Toxic Chemicals within the District and Requiring Notification Thereof.



    WHEREAS, the Board of Directors of the Bolinas Community Public Utility District (“BCPUD”) has an on-going responsibility and desire to protect the health and safety of its employees, of Bolinas residents, of visitors to the district, and of pets and wildlife on district lands;
    WHEREAS, the harmful effects of toxic chemicals on living organisms, including but not limited to children, chemically-sensitive adults and native fauna such as bees, frogs and birds, have been conclusively confirmed and documented in the scientific literature;
    WHEREAS, West Marin is prized for its pristine natural environment of open space, fresh air, protected wetlands and healthy watersheds; and
    WHEREAS, the many organic farms and kitchen gardens of Bolinas could be contaminated and therefore severely damaged by drift and/or runoff from the application of toxic chemicals within the district;
    NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the BCPUD, unless expressly required otherwise by applicable law or by the terms of any written agreement to which the BCPUD is a party, that it is the policy of the district that:
1.    alternatives to chemical herbicides and pesticides should be used whenever possible by persons or entities, whether public or private, within the district for controlling weeds, vermin, harmful insects and other pests;
2.    the least toxic chemical(s) available should be used whenever possible by persons or entities, whether public or private, within the district when non-chemical alternatives fail and/or are ineffective for their intended purpose;

3.    the district shall participate to the extent practicable in public education efforts to promote the use and effectiveness of alternatives to chemical herbicides and pesticides; and
4.    any person or entity, whether public or private, planning to use or apply chemical herbicides and/or pesticides on real property within the district, whether by spray, ground application, fumigation or other means, shall notify neighbors within a 300-foot radius of the intended application area at least 48 hours prior to the planned use or application of such chemical herbicides and/or pesticides.
    IT IS HEREBY CERTIFIED that this resolution was duly introduced and adopted

by the Board of Directors of the Bolinas Community Public Utility District this 18th    

day of October, 2006, by the following vote:
