Resolution No. 569
Declares An Emergency Exists and Authorizes the Installation of Security
Measures to Protect the BCPUD’s Photovoltaic Generation Systems.
WHEREAS, the Board of Directors of the Bolinas Community
Public Utility District (“BCPUD”) previously approved the design and installation
of photovoltaic generation systems at the BCPUD’s Woodrat Water Treatment
Plant and its Wastewater Treatment Facility;
WHEREAS, said photovoltaic generation systems currently
are under construction at these sites;
WHEREAS, within the last two weeks prior to the adoption of this Resolution,
burglary attempts have been made at two privately-owned, ground-mounted photovoltaic
generation systems in the Bolinas community;
WHEREAS, one of the burglary attempts was successful, with the perpetrators
stealing 26 of the 48 system’s panels, and one of the burglary attempts was
not successful, but the perpetrators damaged the system in their attempt
to remove its component parts;
WHEREAS, the successful burglary attempt was widely reported in the local
newspapers (copies of the newspaper articles reporting this burglary are
attached hereto);
WHEREAS, such burglary attempts are unprecedented in the
Bolinas community; and
WHEREAS, an assessment of reported events in the San Francisco Bay Area suggests
that such burglary attempts are a very recent phenomenon, but an increasing
problem at the present time.
NOW, THEREFORE, the BCPUD Board of Directors hereby finds:
1. Based on the foregoing recitals, the Board finds that
there is a sudden and unexpected but demonstrated need for the BCPUD to take
immediate steps to protect its photovoltaic generation systems from theft
and/or attempted theft.
2. An emergency condition therefore exists and the BCPUD
must take immediate action to install appropriate security measures
to protect its photovoltaic generation systems to prevent or mitigate an
imminent loss of public property.
3. It is not practicable to specify in this Resolution
precisely the security measures that the BCPUD shall install to protect its
property but the district finds that such security measures are necessary
to protect the photovoltaic generation systems.
4. The BCPUD photovoltaic generation systems represent
a substantial investment of public funds by the Bolinas community
5. The circumstances do not permit a competitive bid process
due to the imminent need to protect valuable public property from a demonstrated
and imminent risk of theft.
THEREFORE, BE IT RESOLVED THAT the BCPUD Board of Directors hereby authorizes
the solicitation of informal bids from two or more qualified contractors
and/or providers of services and directs the district to act as quickly as
practicable to install and/or implement necessary and appropriate short-term
and/or long-term security measures to protect the BCPUD’s photovoltaic generation
systems.
IT IS HEREBY CERTIFIED that this resolution was duly introduced
and adopted by the Board of Directors of the Bolinas Community Public Utility
District this 10th day of September, 2008, by the following vote:
