Bolinas Community Public Utility District
Resolution No. 571
Designates the BCPUD’s General Manager as the BCPUD’s Authorized Representative
and Authorizes the Submission of a Loan Application on behalf of the BCPUD
to the California Department of Public Health’s Safe Drinking Water State
Revolving Fund program.
WHEREAS, the Bolinas Community Public Utility District
(“BCPUD”) has a critical water main located under sections of Terrace Avenue,
including but not limited to the portion of Terrace Avenue known as “Surfer’s
Overlook”;
WHEREAS, the BCPUD, the Bolinas Fire Protection District and many Bolinas
residents have advised the County of Marin for years that the County’s seawall
at the base of Surfer’s Overlook is failing and is in need of immediate repair;
WHEREAS, despite the foregoing facts, the County of Marin’s Department of
Public Works recently advised the Bolinas Community that it has recommended
that the County “take no measures to attempt to maintain, reinforce or replace
the [sea]wall” below Surfer’s Overlook, despite the Department of Public
Works’ own acknowledgement that the wall “needs to be replaced” and “the
failure of this wall will ultimately hasten the loss of Terrace Avenue at
this location.”
WHEREAS, the failure of the County seawall at the base
of Surfer’s Overlook eventually will lead to a catastrophic failure of Terrace
Avenue, a County-maintained road, and the BCPUD’s water main at this location;
WHEREAS, this present degradation and/or loss of Terrace Avenue at Surfer’s
Overlook requires that the BCPUD plan, design and install an alternative
to the existing water main at this location so that the district does not
face a public health emergency in the form of an inability to provide water
service to a large segment of its customers;
WHEREAS, the BCPUD has received an invitiation to submit an application to
the California Department of Public Health’s Safe Drinking Water State Revolving
Fund loan program for the funds necessary to pay for the planning, design
and installation of an alternative to the above-described water main;
NOW, THEREFORE, BE IT RESOLVED by the BCPUD’s Board of Directors that its
General Manager is hereby designated by Bolinas Community Public Utility
District, a public entity established under the laws of the State of California,
as the district’s Authorized Representative for purposes of submitting a
loan application to the California Department of Public Health’s Safe Drinking
Water State Revolving Fund loan program.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the BCPUD’s Board of Directors
that the BCPUD’s Authorized Representative is hereby authorized to submit
a loan application on behalf of the BCPUD to the California Department of
Public Health’s Safe Drinking Water State Revolving Fund loan program for
the funds necessary to pay for the planning, design and installation of an
alternative to the district’s existing water main under Terrace Avenue at
Surfer’s Overlook.
IT IS HEREBY CERTIFIED that this resolution was duly introduced
and adopted by the Board of Directors of the Bolinas Community Public Utility
District at a special meeting held this 29th day of October 2008, by the
following vote:
