BCPUD Water Moratorium

In November, 1971, the BCPUD Board of Directors declared a Water Shortage Emergency Condition, pursuant to the California Water Code, and enacted a moratorium on new connections to the municipal water supply.  That moratorium is still in effect and should be taken into consideration when contemplating the purchase of undeveloped real estate.   Listed below are two documents that provide information about the moratorium.   Resolution 173, adopted in 1977, is the legislation currently governing the moratorium.  The Pacific Legal Foundation Versus BCPUD is a report on litigation contesting the validity of the moratorium in State and Federal Court.
